ELSS, sector, theme and Life Cycle funds explained
Four fund types that come with a built-in feature: a lock-in, a narrow focus or a target date. Here are SEBI's rules, the India tax for FY 2026-27 and the old retirement and children's funds.
Prepared by Prem Tax and Accounting Corp. Last checked against official sources on November 5, 2026.
Four kinds of Indian fund carry a built-in feature: ELSS a lock-in, sectoral and thematic funds a narrow focus, and Life Cycle funds a target date. The Lock-and-Glide Label Sheet below shows what to note for each. It recommends nothing.
- ELSS: 80% equity and a 3-year lock-in from each purchase (an ELSS 2005 rule, not a SEBI one).
- Sectoral and thematic are separate categories since 2026.
- Life Cycle Funds replaced the Retirement and Children's category in February 2026.
- India, FY 2026-27: usually equity-oriented, so 20% on short-term gains and 12.5% on long-term gains above Rs 1.25 lakh a year.
What SEBI requires
| Category | Rule |
|---|---|
| ELSS (Tax Saver) | 80% equity; active, or passive on an index of the top 250 companies, not both |
| Sectoral | 80% in one sector on AMFI's list; existing funds meet the overlap limit within 3 years of 26 February 2026 or merge |
| Thematic | 80% in one theme on AMFI's list; same overlap rule |
| Life Cycle | Glide path below; no more than 6 open for any one fund house; exit load of 3%, 2% and 1% across years 1 to 3 |
| Years to maturity | Equity | Debt |
|---|---|---|
| Under 1 | 5-20% | 25-65% |
| 1 to 3 | 20-35% | 25-65% |
| 3 to 5 | 35-50% | 25-50% |
| 5 to 10 | 50-65% | 5-25% |
| 10 to 15 | 65-80% | 5-25% |
| 15 to 30 | 65-95% | 5-25% |
Every band also allows 0-10% in gold and silver ETFs or derivatives, plus InvITs. AMFI listed 6 Life Cycle Funds and 41 legacy solution schemes on 30 September 2026.
India tax treatment, FY 2026-27
| Fund | Treatment |
|---|---|
| ELSS | Equity-oriented; 12.5% above Rs 1.25 lakh a year after the lock-in. Deduction up to Rs 1.5 lakh, old regime only; NRIs and OCIs qualify |
| Sectoral, thematic | Equity-oriented only if 65% sits in listed Indian shares |
| Life Cycle | The class follows each year's holdings and can change over the fund's life |
NRI tax deducted: 20% or 12.5% plus surcharge and 4% cess.
Abroad in short
- USA: reported like any Indian scheme, usually as a PFIC. We found no source giving ELSS or retirement-type funds IRA-style relief.
- Canada: no PFIC regime; the units do not appear to qualify for a TFSA, RRSP, RESP or FHSA.
- UK and Germany: HMRC's list of 2 November 2026 has no ELSS, sector or theme fund. In Germany a change in a Life Cycle Fund's exemption rate counts as a deemed sale and repurchase; the tax falls on actual sale.
Our checklist
The Lock-and-Glide Label Sheet, per holding:
- Category, and for ELSS the date each instalment unlocks.
- The stated sector or theme.
- For Life Cycle funds, the maturity year and current equity share.
- For old retirement or children's funds, the fund house's latest notice.
Mistakes people make
- Claiming the ELSS deduction under the default tax regime.
- Treating a Life Cycle fund's tax class as fixed.
Check dates and rates each April.
Common questions
Is the ELSS lock-in one date or many?
Many: each SIP instalment has its own 3-year lock.
Did SEBI abolish retirement funds?
SEBI discontinued the category on 26 February 2026, but its Master Circular lets a fund house keep or merge a fund. Check its notice.
Can NRIs claim the ELSS deduction?
Yes, under the old regime only. The Income-tax Act 2025 gives it to individuals and Hindu undivided families with no residence test.
