Common questions
What is the Applicable Federal Rate (AFR)?
The minimum interest rate the IRS considers adequate on loans between related parties and on certain installment sales. It is published monthly for short-term (up to 3 years), mid-term (over 3 up to 9 years) and long-term (over 9 years) loans.
When do I need it?
Loans to or from family members and owners, seller-financed sales, below-market loans, installment sales of property, and some estate planning techniques. If you charge less than the AFR, the IRS can treat the difference as a gift or income.
Which month's rate applies?
For a typical term loan, the rate in effect when the loan is made is the one that applies for the whole term. The rate is chosen by the length of the loan and the compounding period.
What is the Section 7520 rate?
A rate used to value annuities, life estates, remainders and charitable interests, and for some estate planning trusts. It is 120% of the mid-term AFR (rounded) for the month.
