EU rules and CRS: why platforms skip Indian funds, and who sees your folio
European rules govern who may sell a fund, not who may own one. Separately, India reports your folio to your home tax office. Here is how both work and what is not settled.
Prepared by Prem Tax and Accounting Corp. Last checked against official sources on November 5, 2026.
On our reading, Indian schemes do not fit the rules for retail fund platforms in the EU, UK and Switzerland, but those rules bind sellers, not owners. Separately, India reports your folio to your home tax office. Our Border-to-Border Data Trail follows both. Your adviser files; we work alongside. See the countries guide and our Indian CPA page.
- We found no EU rule that bars a resident from holding Indian units. A fund house accepting you is its own policy; see fund houses that restrict.
- A seller must give a retail client a key information document (KID) before a sale (the EU's PRIIPs rules, since January 1, 2018). An Indian scheme cannot be a UCITS (an EU-approved retail fund); on our reading it is a non-EU alternative fund.
- The Indian fund reports each reportable folio to India's tax department by May 31: year-end value plus gross payouts and redemptions. The EU PRIIPs overhaul, agreed December 18, 2025, is not law.
How data reaches home
| Place | Link with India | Year |
|---|---|---|
| UK, Germany, France, Netherlands | CRS | Own commitment: 2017 |
| Canada | CRS | Own commitment: 2018 |
| Switzerland | CRS | Data from 2018, exchange from 2019 |
| USA | FATCA agreement | In force August 31, 2015 |
| UAE, Qatar, Oman, Kuwait, Bahrain | India receives, sends none | OECD table, November 2, 2026 |
CRS is the OECD's Common Reporting Standard; FATCA is the U.S. law. India signed the CRS agreement on June 3, 2015 and committed to September 2017. A partner's commitment is not a confirmed first exchange.
What the report holds
- India's rules ask for name, address, tax ID, folio number, year-end value and gross amounts paid, including redemptions. A U.S. citizen living in India is still reportable.
- You give a self-certification of tax residence at opening, and a new one if things change.
- The penalty falls on the fund; Rs 5,000 per account can be recovered from a holder who gave false details.
Our checklist
The Border-to-Border Data Trail:
- Record your tax residence and tax ID for each country on every self-certification.
- Note the date of any move, then update the fund house and KYC.
- Compare the fund's year-end value and payouts with your own return each spring.
- Keep annual statements by calendar year, not April to March.
Common questions
Can I own Indian mutual funds if I live in Europe?
We found no EU rule that stops it. Whether a fund house takes you is its own policy.
Does India send my fund data to my country?
If India has an active CRS exchange with your country, yes; the USA gets it under FATCA. The Gulf states above send data to India but get none back.
Is the EU PRIIPs overhaul in force?
No. A deal was agreed on December 18, 2025, with a Parliament vote indicated for November 11, 2026.
