India new 52-week highs: upper circuits, surveillance and the tax on a gain
The screener shows Indian securities at their highest price of the past 52 weeks. A high describes the past year. Here is how Indian exchanges limit sharp moves, how they flag prices out of step with fundamentals, and how gains are taxed.
Prepared by Prem Tax and Accounting Corp. Last checked against official sources on October 23, 2026.
The India new 52-week highs list shows Indian-listed securities trading at the highest price of the past year. It is a statement about price history and nothing else. It does not say whether a rise will continue, and in India it also does not say whether the exchange has already started to restrict the stock.
- A high compares a security with its own past year.
- Indian exchanges cap daily moves with price bands, so a strong stock can spend days at its limit.
- Rates of tax on Indian gains have changed recently, so always check the Income Tax Department's current page.
What this list shows
The screener below is set to its “above 52-week high” view for India. It lists securities whose latest price is at or above the highest of the previous 52 weeks. The window rolls forward every day, so an old peak that drops out lowers the bar for a fresh high.
The live list loads when you scroll to this spot.
It is a free screener from TradingView, shown inside this page.

When the market itself steps in
Two layers limit sharp moves. The first is the daily price band on each security, described on our most active page for India. The second is the market-wide circuit breaker. NSE says an index-based system applies at three stages of index movement either way, at 10%, 15% and 20%, triggered by the BSE Sensex or the Nifty 50 whichever is breached earlier. When one triggers, there is a coordinated halt in all equity and equity derivative markets nationwide, and the market reopens with a pre-open call auction.
| Index fall (Sensex or Nifty 50, whichever is breached first) | If it happens | Market halt |
|---|---|---|
| 10% | Before 1:00 p.m. | 45 minutes, then a 15-minute pre-open call auction |
| 10% | At or after 1:00 p.m. and before 2:30 p.m. | 15 minutes, then a 15-minute pre-open call auction |
| 10% | At or after 2:30 p.m. | No halt |
| 15% | Before 1:00 p.m. | 1 hour 45 minutes, then a 15-minute pre-open call auction |
| 15% | At or after 1:00 p.m. and before 2:00 p.m. | 45 minutes, then a 15-minute pre-open call auction |
| 15% | At or after 2:00 p.m. | Rest of the day |
| 20% | Any time during market hours | Rest of the day |
Surveillance: prices out of step with fundamentals
NSE's Graded Surveillance Measure (GSM) covers securities whose price is not commensurate with financial health and fundamentals, such as earnings, book value, fixed assets, net worth, P/E multiple and market capitalization. The list of such securities is published on the exchange's website, and NSE says all market participants dealing in them have to be extra cautious and diligent. Restrictions the exchanges and SEBI may add include trade-for-trade settlement, an additional surveillance deposit, once-a-week trading and freezing the price on the upper side. A stock on a highs list may or may not be on that list, so check the exchange's page before reading anything into a high.
How India taxes a gain on listed shares
| Type of gain | What the Income Tax Department's pages showed on October 23, 2026 |
|---|---|
| Short-term gain on listed equity shares or equity-oriented fund units sold on a recognised exchange (section 111A) | Taxed at 20% for transfers on or after July 23, 2024, with a 15% rate for earlier transfers. Securities transaction tax (STT) must have been paid, with an exception for certain transactions on an exchange in an International Financial Services Centre. |
| Long-term gain on those securities (section 112A) | Taxed at 12.5% on gains above Rs. 125,000 for the year (10% for transfers on or before July 22, 2024), when STT was paid on transfer, and for equity shares generally also on acquisition. |
| Shares acquired before February 1, 2018 | A special rule sets the cost of acquisition at the higher of actual cost or the lower of the fair market value on January 31, 2018 and the sale price. |
These are descriptions of the department's pages on the date shown, not a tax computation. Holding periods that decide short-term or long-term treatment depend on the type of asset, and the rates move with each Finance Act. Take the current figures from the department's pages on long-term and short-term gains, and from an Indian adviser, before you rely on a rate.
How the U.S. sees the same gain
- Worldwide income. A U.S. citizen or resident reports the gain on the U.S. return even though India taxed it.
- Computed in dollars. Purchase and sale are each translated at documented rates, so rupee moves can change the size of the U.S. gain. See our forex page.
- Relief for double tax. The IRS says that if you pay income tax to a foreign country you may take either a credit or an itemized deduction. The IRS also keeps a page of India tax treaty documents.
- Funds. Indian mutual funds are often passive foreign investment companies for U.S. purposes, with Form 8621. See India accounts, investments and property.
Common questions
What is an “upper circuit”?
It is the point at which a security reaches the top of its daily price band and cannot trade higher that day. NSE sets daily bands of 2%, 5%, 10% or 20% either way, depending on the security.
Does a stock under the Graded Surveillance Measure have a problem?
It means the exchanges and SEBI have flagged its price as not commensurate with its financial health and fundamentals, and may add restrictions such as trade-for-trade, a surveillance deposit or once-a-week trading. It is a caution to investors, not a verdict on the company.
Do Indian capital gains rates change?
Yes. The Income Tax Department's pages show the rate changes that took effect for transfers on or after July 23, 2024, and rates can change again with each Finance Act. Read the department's current page for the year of your sale.
How do I turn an Indian gain into a number for my U.S. return?
You translate the purchase and the sale into U.S. dollars at documented rates and compute the gain in dollars, so the U.S. gain can differ from the gain in rupees. Our forex page lists the sources each return uses.
