Illinois OSHA: which safety agency covers your workplace
Illinois OSHA covers public employers only, while private employers answer to federal OSHA. Slides, penalty numbers and a short checklist sort out the split.
Prepared by Prem Tax and Accounting Corp. Last checked against official sources on October 29, 2026.
Illinois OSHA enforces workplace safety under 820 ILCS 219, but only for state and local government. In Illinois, private employers fall under federal OSHA. Our Hallway-Fork Safety Pass sorts out which path applies. The statute is on the Illinois General Assembly site.
- Private-sector employers, small ones too, are federal OSHA territory.
- Public bodies, including schools and public universities, fall under Illinois OSHA.
- Illinois public penalties reach $10,000 per violation; federal 2026 maximums are higher.
- A 2025 law adds a narrow private-sector backstop, with no rule found yet.

Our checklist
Our Hallway-Fork Safety Pass has four stops:
- Sort: private, public or federal? A private contractor on a public site is a question for an attorney.
- Private path: follow federal OSHA; see our OSHA page.
- Public path: post the Job Safety and Health poster, the Form 300A summary and any citation.
- Free help: small private businesses can ask for IDOL's free On-Site Consultation.
Mistakes people make
- Believing Illinois OSHA visits private businesses. It does not.
- Assuming that means no exposure. Federal OSHA covers private workplaces in Illinois.
- Public employers retaliating against a worker who reported a hazard, even only to a manager with authority to act.
Consider an attorney for any inspection, citation or retaliation complaint. A fine paid to a government is generally not deductible; see small business compliance.
Common questions
Can Illinois OSHA cite a private business?
No. It covers state and local government. A narrow 2025 law could lead to state rules for private employers, as described above, but we found none in October 2026.
Is there free safety help for a small business?
Yes. IDOL runs a free, confidential On-Site Consultation Program for small and midsize businesses. It offers advice, not enforcement, though an owner who refuses to correct serious hazards is referred to an enforcement office.
Does Illinois OSHA cover school districts?
Yes. School districts, other local governments and public university staff are covered under 820 ILCS 219.
